We collect the following data through the services you use:
Technical data: such as IP address, browser type, information about your computer, data related to the approximate current location of the device you are using; data collected using cookies or similar technologies: for more information, please visit the "Cookie" section at the bottom of the page.
1. HOW DO WE USE THE COLLECTED DATA?
We use the collected data to provide you with our service every day, to inform you about our business activities, or to offer you a more personalized service in line with your interests.
1.1. To guarantee access to our services and improve their provision
We use your data to guarantee access to our services and their provision, including: registration and creation of the reserved area, use of the "favorites" and "saved carts" features.
These processing activities are necessary to correctly provide SparesGarden.com services to users who join them. We also use your data to improve and enhance the service through the following processing activities: detection of your approximate current location to facilitate the use of certain functions, such as market research, optional surveys, and user satisfaction assessment activities.
These processing activities are based on the legitimate interest of the Data Controller (see point 3.1), and you can object to them at any time.
1.2. To inform you about our business activities
If you have expressly given us consent, we use the collected data to inform you about promotional activities that may be of interest to you. In particular, we use them to: communicate promotional, commercial, and advertising activities regarding events, initiatives, or partnerships of SparesGarden.com through email, SMS, or push notifications; only if you are a professional, make phone calls through operators, provide dedicated customer care services during sales and after-sales activities, conduct analysis and reporting activities related to promotional communications, such as tracking the number of opened emails, clicks on links within the communication, the type of device used to read the communication, and the operating system, or the list of unsubscribed newsletter recipients.
1.3. To offer you a personalized service
If you have expressly given us consent, we process the collected data to analyze your habits or consumer choices in order to offer you a more personalized service in line with your interests and improve our commercial offer. These analyses are not in any case related to automated decision-making processes.
2. IS THE PROVISION OF DATA MANDATORY?
The provision of personal data is mandatory only to complete the purchase on our website SparesGarden.com (any refusal for service delivery purposes makes it impossible to use the service); it is optional for promotional and profiling purposes (newsletter subscription), and any refusal to give consent has no negative consequences on the provision of the service offered on the website www.SparesGarden.com and related applications.
3. WHO ARE THE DATA SUBJECTS?
We use the collected data to provide you with our service every day, to inform you about our business activities, or to offer you a more personalized service in line with your interests.
3.1. Data Controller
The Data Controller is Agromeccanica S.r.l., represented by its temporary legal representative, with registered office in Trieste (IT), Via Flavia di Aquilinia, 16, VAT and tax code 00663880326. The Data Controller relies on data processors to achieve the purposes specified in point 1 and a Data Protection Officer (DPO) to ensure the protection of personal data. For any request regarding your personal data, please refer to the following point 3.2.

The designated Data Protection Officer pursuant to Article 37 of the GDPR is Dr. Lorenzo Eller.
Please note that you can contact the DPO at any time and send any questions or requests regarding your personal data and the respect of your privacy by writing to the address commerciale@agromeccanica.it.
3.3. Recipients to whom personal data may be disclosed
The data collected as part of the service may be disclosed to:
companies that perform functions strictly connected and instrumental to the operation, including technical operation, of SparesGarden services, such as suppliers providing services for reviewing and verifying ads, providers of direct marketing and customer care services, companies providing storage, administrative, payment, and billing services, related companies providing technical components for the provision of certain service functionalities, public authorities and administrative and judicial authorities in compliance with legal obligations.
Your personal data may be transferred outside the European Union for processing by some of our service providers. In this case, we ensure that this transfer complies with applicable laws and that an adequate level of data protection is guaranteed based on an adequacy decision, standard clauses defined by the European Commission, or binding corporate rules.
Under no circumstances do we transfer or sell personal data to third parties.
4. HOW CAN YOU OBTAIN INFORMATION ABOUT YOUR DATA, MODIFY, DELETE, OR REQUEST A COPY?
4.1. Access to personal data from your reserved area and withdrawal of consent (opt-out)
You can access your personal data in your reserved area at any time. Log into your account and click on the "My Profile" section.
Please note that you can revoke your consent for promotions you have provided at any time by accessing your reserved area and removing the "Receive the Newsletter" flag.
4.2. Export and deletion of personal data processing
To export your personal data (takeout) or request its deletion, you can send a request to the email address commerciale@agromeccanica.it from the email address you used to register with SparesGarden.
Your personal data will be exported within 30 days or, if the export is particularly complex, within three months.
Deletion will be carried out within the technical timeframes provided and in accordance with the retention period specified in the following point 5.
4.3. Exercise of your rights
Any individual using our service can:
- Obtain from the data controller, at any time, information about the existence of their personal data, the origin of the data, the purposes and methods of processing, and, if applicable, access to personal data and the information referred to in Article 15 of the GDPR.
- Request the updating, rectification, integration, erasure, or restriction of personal data in case one of the conditions provided for in Article 18 of the GDPR applies, as well as the transformation into anonymous form or blocking of personal data processed in violation of the law, including data that does not need to be retained for the purposes for which it was collected or subsequently processed.
- Object, in whole or in part, for legitimate reasons, to the processing of personal data, even if it is relevant to the purpose of collection and processing of personal data for commercial information or sending advertising or direct sales material, or for conducting market research or commercial communication. Each user also has the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
- Receive their personal data, knowingly and actively provided or through the use of the service, in a structured, commonly used, and machine-readable format, and have the right to transmit those data to another data controller without hindrance.
- Lodge a complaint with the Italian Data Protection Authority.

5. HOW LONG WILL YOUR DATA BE RETAINED?
Personal data will be stored in paper and/or electronic/information technology form for the time strictly necessary to fulfill the purposes outlined in point 1, in compliance with your privacy and applicable regulations.
For analysis purposes aimed at the development and improvement of the service, the user's personal data may be subject to the same retention period.
For direct marketing and profiling purposes, we retain your data for a maximum period as prescribed by applicable regulations (respectively, 24 and 12 months).
Invoices, accounting documents, and transaction data are retained for 11 years in accordance with the law, including tax obligations.
In the event of exercising the right to be forgotten through an explicit request for the erasure of personal data processed by the data controller, please note that such data will be stored, in a protected form with limited access, solely for the purposes of investigation and prosecution of crimes, for a period not exceeding 12 months from the date of the request, and subsequently securely erased or irreversibly anonymized.
Please note that, for the same purposes, traffic data, excluding the content of communications, will be retained for a period not exceeding 6 years from the date of communication, in accordance with Article 24 of Law No. 167/2017, which implements EU Directive 2017/541 on counter-terrorism.
If you do not perform any active actions (e.g., browsing, searches, or any other form of service usage) on SparesGarden.com for a period of 27 months, you will be classified as an inactive user, and your personal data will be automatically deleted.
6. HOW DO WE ENSURE THE PROTECTION OF YOUR DATA?
Data is collected by the entities specified in point 3, following the provisions of the relevant regulations, with particular regard to the security measures provided for in Article 32 of the GDPR for their processing using computer, manual, and automated tools and with logic strictly related to the purposes indicated in point 1, ensuring the security and confidentiality of the data.
In compliance with applicable regulations, an anti-spam verification system is active for communications between users. The data entered therein may be verified solely for the purpose of identifying illicit activities or content that does not comply with the General Terms of Service, but they will not be processed or communicated for commercial or promotional purposes.
7. CAN THE PRIVACY POLICY BE CHANGED OVER TIME?
This privacy policy may be subject to changes. In the event of substantial changes to the use of user data by the Data Controller, the user will be notified by publishing such changes prominently on their pages or through alternative or similar means.

Consent for the use of profiling cookies is given by users through the following methods: closing the banner containing the brief information, scrolling the page hosting the banner, or clicking any of its elements. Consent can be revoked at any time.
All technical cookies do not require consent; therefore, they are installed automatically upon access to the website or service.
